Dear Payroll Client

We are also enclosing the state of California Industrial Welfare Commission Summary of Interim Wage Order--2000

It is required to be available. We suggest posting at a location that will be seen by all employees – handing it out to all employees – or a notice (such as the first page with a note of where it is posted. The law states:

“This summary must be made available to employees in accordance with Section 12 of the Interim Wage Order.”

Please note the stiff rules about requiring employee’s makeup time, for time off they requested (and must be in writing), must be in the same week.

All make up time MUST be done in the SAME workweek. For example, assuming you work week starts on Monday, if an employee takes off 2 hrs on Friday at the end of the day, they must make it up on that Saturday or if they do not work Saturday on Sunday. If you let them make it up the next week and they exceed 8 hrs per day or 40 hrs per week you have to pay them at overtime at 1.5 times their normal rate. The law states:

“Make Up Time - If an employer approves a written request of an employee to make up work time that is or would be lost as a result of a personal obligation of the employee, the hours of that make up work time, if performed in the same workweek in which the work time was lost, may not be counted toward computing the total number of hours worked in a day for purposes of the overtime requirements, except for hours in excess of 11 hours of work in 1 day or 40 hours of work in 1 workweek.”
